1. About these terms
These terms govern your use of this website. The website is operated by Upaaywala India Pvt. Ltd., a private limited company incorporated in India at 40/1A, Poushyaa Complex, Vijaya Bank Layout, Kodichikkanahalli, Bengaluru, Karnataka 560076 ("Upaaywala", "we", "us"). By using the website, you agree to these terms. If you do not agree, please do not use the website.
2. What the website does
The website presents information about pooja services, temple services, astrology consultations, spiritual products and related guides. You can submit an enquiry about a listing.
An enquiry is a request for information. It is not a booking, an order or a contract. A service or sale is confirmed only when we send you a written service plan or order confirmation that states:
- the provider; - the date, time and location, or the online arrangements; - what is included and what is not; - the final price, including taxes; and - the cancellation terms.
You must accept that confirmation before anything is binding. We do not take payment when you submit an enquiry.
3. Who performs services
Pooja and temple services are performed by our own priests. Astrology consultations are given by independent astrologers who consult through Upaaywala; each astrologer's profile shows the experience, languages and specialities we have confirmed with them. Your confirmation names the priest or astrologer. We verify the identity, role and availability of providers before we list a service, and we remain your point of contact for the service we confirm.
4. Belief, tradition and no guaranteed outcomes
Spiritual, ritual and astrological practices are matters of personal belief and tradition. Our services, consultations and products are not offered as a cure or treatment for any disease, and they are not a substitute for medical, legal, financial or other professional advice. We do not promise any particular personal, financial, health, relationship or legal result. Please consult a qualified professional for those matters.
5. Products
We describe products as accurately as we can. Where appearance, weight, origin, treatment or certification matters, the details for the exact item are confirmed before sale. Any certificate is issued by the laboratory named on it. Service photographs show the type of ritual or setting, and your own service may look different. Product photographs show the item or one of the same type, and the exact item is confirmed before sale. Delivery, returns and refunds are covered by our Shipping and Fulfilment Policy and our Cancellation, Refund and Rescheduling Policy.
6. Prices and payment
Prices are in Indian rupees. A displayed product price is the maximum retail price, inclusive of all taxes, unless stated otherwise. Service prices are confirmed in your written plan, with each component listed, as explained on our Pricing Information page. When online payment becomes available, only the payment methods shown on the website will be accepted. You will see the full price, including any charge, before you pay.
7. Your responsibilities
When you use the website, you agree:
- to give accurate information and to keep your contact details current; - not to submit enquiries, reviews or grievances on behalf of someone else without their permission; - not to misuse the website, attempt unauthorised access, disrupt its operation, or scrape or copy its content at scale; and - not to upload unlawful, defamatory, obscene, hateful or misleading content, or content that infringes anyone's rights.
8. Reviews
Reviews must describe your own genuine experience of a service or product. We moderate every review before publication and may decline reviews that are not genuine, are abusive or irrelevant, reveal personal data, or advertise something. We do not pay for reviews or edit a reviewer's words. A "verified" badge appears only where a supplied booking or order reference has been matched. By submitting a review, you allow us to publish your name, rating and review text on the website. You can ask us to withdraw it at any time.
9. Content and intellectual property
The website's text, design, original photographs and graphics belong to us or our licensors. You may view and share pages for personal, non-commercial use. Any other copying, republication or commercial use needs our written permission.
10. Liability
We take reasonable care in preparing the website and arranging services. To the extent permitted by law, we are not liable for indirect or consequential losses, or for interruptions to the website beyond our reasonable control. Nothing in these terms limits any right you have under the Consumer Protection Act, 2019 or other law that cannot be excluded by contract.
11. Complaints and grievances
If something goes wrong, please contact support at customercare@upaaywala.com or +91 90712 03001, or use the grievance page on this website. Our grievance officer, Anshul Tyagi, Grievance Officer, will acknowledge your complaint within 48 hours and aim to resolve it within one month of receipt. You can also approach the National Consumer Helpline or a consumer commission.
12. Governing law
These terms are governed by the laws of India. Subject to your rights as a consumer to approach the forum of your choice, the courts at Bengaluru have jurisdiction.
13. Changes
We may update these terms by posting a new version with a new effective date. The version in force when your service or order was confirmed applies to that service or order.
